Agreement Overview

These Terms and Conditions constitute a legal agreement between you (the "Resident" and/or "Family Representative") and merigolesa ("we," "us," or "our"), governing the provision of senior residential care services at our facility in Mae Rim, Chiang Mai, Thailand.

1. Definitions

The following terms shall have the meanings set forth below:

  • "Services" refers to the residential care, companionship, and countryside engagement programs offered by merigolesa
  • "Resident" means the individual receiving care services
  • "Family Representative" means the authorized family member or legal representative acting on behalf of the Resident
  • "Facility" means the merigolesa residential care property located at 35/2 Moo 4, Mae Rim, Chiang Mai 50180, Thailand
  • "Agreement" means the service contract executed between merigolesa and the Resident or Family Representative
  • "Monthly Fee" refers to the recurring payment for selected services

2. Service Description

2.1 Scope of Services

merigolesa provides non-medical residential care services including:

  • Veranda Companion Service: Daily personal care assistance and companionship
  • Countryside Engagement Program: Organized activities leveraging Mae Rim's natural surroundings
  • Countryside Residential Living: Comprehensive residential care with private accommodations

2.2 Service Limitations

Our services do NOT include:

  • Medical care, nursing services, or medical treatment
  • Administration of medications (residents must manage their own medications)
  • Specialized dementia or Alzheimer's care requiring secured environments
  • Intensive physical therapy or rehabilitation services
  • Emergency medical response beyond contacting appropriate healthcare providers

3. Admission Requirements

3.1 Eligibility

To be eligible for merigolesa services, individuals must:

  • Be at least 55 years of age
  • Be able to participate in activities of daily living with assistance
  • Not require intensive medical or nursing care
  • Demonstrate compatibility with our community-oriented living environment

3.2 Assessment Process

Prior to admission, we conduct an assessment to determine if our services align with the individual's needs. This assessment may include discussions about health background, mobility considerations, social preferences, and support requirements. merigolesa reserves the right to decline admission if we determine our services are not appropriate for the individual's care needs.

3.3 Required Documentation

The following documents must be provided before admission:

  • Valid identification (passport for international residents)
  • Current visa documentation (if applicable)
  • Emergency contact information
  • Healthcare provider contact information
  • Signed service agreement and payment authorization

4. Payment Terms

4.1 Service Fees

Current monthly fees are:

  • Veranda Companion Service: ฿5,500 per month
  • Countryside Engagement Program: ฿14,200 per month
  • Countryside Residential Living: ฿40,000 per month

4.2 Payment Schedule

  • Monthly fees are due on the first day of each calendar month
  • Initial payment includes the first month's fee plus a refundable security deposit equal to one month's fee
  • Accepted payment methods include bank transfer, credit card, and cash
  • Late payments (after the 10th of the month) incur a 5% late fee

4.3 Fee Adjustments

merigolesa reserves the right to adjust service fees annually with 60 days' written notice. Current residents will receive advance notification of any fee changes.

5. Termination and Cancellation

5.1 Voluntary Termination by Resident

Residents or Family Representatives may terminate services with 30 days' written notice. The security deposit will be refunded within 30 days following departure, minus any outstanding balances or damages.

5.2 Termination by merigolesa

merigolesa may terminate services under the following circumstances:

  • Non-payment of fees for more than 15 days past the due date
  • The Resident's care needs exceed our non-medical service capabilities
  • Behavior that disrupts community harmony or creates safety concerns
  • Provision of false information during the admission process

In such cases, we will provide 30 days' notice when possible and work with the Family Representative to coordinate an appropriate transition.

5.3 Immediate Termination

merigolesa reserves the right to immediate termination in cases of violence, illegal activity, or severe endangerment to self or others.

6. Resident Rights and Responsibilities

6.1 Resident Rights

  • Right to respectful, dignified care tailored to individual preferences
  • Right to privacy in personal space and communications
  • Right to participate in or decline activities
  • Right to receive visitors during reasonable hours
  • Right to access personal belongings and private funds
  • Right to transparent communication about services and policies

6.2 Resident Responsibilities

  • Treat staff, fellow residents, and visitors with respect
  • Comply with facility policies regarding safety and community living
  • Provide accurate information about health status and care needs
  • Maintain personal hygiene and room cleanliness (with assistance as needed)
  • Notify staff of medication changes or health concerns
  • Respect others' privacy and personal space

7. Health and Safety

7.1 Medical Emergencies

In medical emergencies, merigolesa staff will contact emergency services and the designated Family Representative immediately. We are not equipped to provide emergency medical care and will coordinate with appropriate healthcare providers. Any costs associated with emergency medical services are the responsibility of the Resident or Family Representative.

7.2 Medication Management

Residents are responsible for managing their own medications. Staff may provide reminders but cannot administer medications. For residents requiring medication administration, we can coordinate with external nursing services at additional cost.

7.3 Safety Protocols

merigolesa maintains safety measures including staff presence, emergency contact systems, and facility maintenance. However, we cannot guarantee absolute safety from accidents, health events, or natural occurrences.

8. Liability and Insurance

8.1 Limitation of Liability

merigolesa provides non-medical residential care services and assumes no responsibility for medical conditions, health events, or accidents beyond our reasonable control. We maintain appropriate liability insurance but are not liable for losses or damages resulting from:

  • Pre-existing health conditions or natural health decline
  • Resident decisions to decline recommended care or safety measures
  • Acts of nature, civil unrest, or other force majeure events
  • Loss or damage to personal property (residents should maintain personal insurance)

8.2 Insurance Recommendations

We strongly recommend that residents maintain personal health insurance and property insurance for personal belongings. merigolesa's liability coverage does not extend to residents' personal property.

9. Personal Property

Residents may furnish private rooms with personal items within reasonable limits. merigolesa is not responsible for loss, theft, or damage to personal property. We recommend limiting valuable items and maintaining appropriate insurance coverage.

Upon departure, all personal property must be removed within 14 days. Items left beyond this period may be donated or disposed of at merigolesa's discretion.

10. Privacy and Confidentiality

merigolesa respects resident privacy and maintains confidentiality of personal information in accordance with our Privacy Policy and Thai data protection laws. Staff members are trained in confidentiality protocols and access to resident information is limited to authorized personnel.

11. Dispute Resolution

11.1 Informal Resolution

We encourage open communication to resolve any concerns. Residents or Family Representatives should first discuss issues with our management team. We commit to addressing concerns promptly and working toward mutually acceptable solutions.

11.2 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes that cannot be resolved informally shall be subject to the jurisdiction of courts in Chiang Mai Province, Thailand.

11.3 Mediation

Before pursuing legal action, parties agree to attempt mediation through a mutually acceptable mediator to resolve disputes.

12. Changes to Terms

merigolesa may modify these Terms and Conditions with 60 days' written notice to current residents and Family Representatives. Continued use of services after the notice period constitutes acceptance of updated terms.

Material changes affecting service delivery, fees, or resident rights will be communicated clearly with options for discussion before implementation.

13. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under Thai law, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.

14. Entire Agreement

These Terms and Conditions, together with the executed service agreement and any supplemental policies provided at admission, constitute the entire agreement between merigolesa and the Resident or Family Representative. Verbal agreements or representations not documented in writing are not binding.
